  • Forty-six-year-old James Hutchins was in custody Thursday on a $10,000 bond, pending an Aug. 2 court hearing.

A jail officer said there was no record of Hutchins having a lawyer.

The Chattanooga Times Free Press reports that Hutchins has a prior conviction on the same charge, dating back to 1999 when he was sentenced to six months in jail and placed on probation for five years.

Records say lab tests show Hutchins' wife of almost five years has tested HIV positive. Friends told her Hutchins was HIV positive. The couple met online in 2005 and married about a year later.
